Terms of Service

These terms govern access to LiftSignal's website, research services, secure delivery links, and customer deliverables.

The service

LiftSignal organizes public elevator and conveyance records, preserves source context, adds property and organization research, and prepares human-reviewed market-intelligence deliverables. Coverage, sources, fields, freshness, and availability vary by jurisdiction and may change.

Research limitations

A LiftSignal record or brief is a research aid, not proof of unsafe equipment, a code violation, current noncompliance, ownership, unawarded work, or an available service contract.

LiftSignal is not an inspection authority, engineering firm, elevator contractor, legal service, safety determination, or compliance certification. Public records may be incomplete, delayed, inconsistent, corrected, or superseded after retrieval.

Your responsibility

You are responsible for independently verifying material facts and deciding whether and how to act on the information. You are also responsible for complying with applicable solicitation, privacy, public-record, licensing, and industry rules when using LiftSignal information.

Accounts, links, and authorized access

Staff accounts are invitation-only. Customer deliveries may use private, expiring links rather than customer accounts. You must protect credentials and links, limit them to authorized recipients, and notify us promptly if you believe access has been compromised. You may not bypass access controls or attempt to obtain another customer's information.

Orders, subscriptions, and payment

If LiftSignal offers a paid order or subscription, its price, included volume, delivery cadence, renewal, and cancellation terms will be shown in the applicable checkout, order, or written agreement. Payments may be processed by Stripe. Recurring subscriptions continue until canceled under the applicable offer terms. Except where required by law or stated in an order, fees already paid are non-refundable.

Permitted use

Unless an order or written agreement says otherwise, customer deliverables are licensed for the customer's internal business research and may not be resold or republished as a database or lead product.

You may not use LiftSignal to harass people, make deceptive or unlawful claims, infer protected characteristics, violate access restrictions, create a competing data product, or present LiftSignal research as an official government, engineering, inspection, safety, or compliance determination.

Sources, ownership, and corrections

Third-party and public-source materials remain subject to their own rights and restrictions. LiftSignal retains its rights in its software, workflow, research organization, presentation, and original content. If a source or delivered statement appears inaccurate, contact us. We may investigate and issue a corrected version; we do not silently alter an already delivered artifact.

Confidentiality

Each party must use reasonable care to protect non-public information received from the other and use it only for the service relationship. This does not cover information that is public through no breach, independently developed, lawfully received from another source, or required to be disclosed by law.

Availability and warranties

LiftSignal is provided on an “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted availability, complete source coverage, a particular business result, or that a record will produce a sales opportunity.

Limitation of liability

To the fullest extent permitted by law, LiftSignal and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Aggregate liability arising from the service will not exceed the amount you paid for LiftSignal during the 12 months before the event giving rise to the claim, or $100 if you paid nothing. These limits do not apply where applicable law does not permit them.

Suspension and termination

We may suspend or terminate access for nonpayment, misuse, security risk, legal requirements, or material breach. Sections that by their nature should survive termination, including ownership, payment obligations, disclaimers, and liability limits, will survive.

Governing law and changes

Massachusetts law governs these terms, without regard to conflict-of-law principles. Courts located in Massachusetts will have exclusive jurisdiction unless applicable law requires otherwise. We may revise these terms as LiftSignal changes; material revisions will be reflected by a new effective date.
